1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the meerkatpos.me website and the meerkatPOS software available for download from it, provided by Rootwise Inc. ("Rootwise," "we," "us," or "our"). By downloading, installing, or using meerkatPOS, or by using this website, you agree to these Terms. If you're agreeing on behalf of a business, you're confirming you have the authority to do so.

2. The service

meerkatPOS is offline-first point-of-sale and accounting software built on the open-source Frappe Framework and ERPNext. It connects to an ERPNext server that Rootwise sets up for your business as part of onboarding you as a customer; this isn't something you configure on your own. This website provides information about meerkatPOS and hosts installers for download, but getting a working installation requires contacting us first. See Section 4 for how your server is handled.

3. License to use the software

Subject to these Terms, Rootwise grants you a non-exclusive, non-transferable license to install and use meerkatPOS for your own internal business operations. You may not reverse engineer, resell, sublicense, or redistribute meerkatPOS as your own product without our prior written permission. meerkatPOS is built on Frappe Framework and ERPNext, which are separate open-source projects governed by their own respective licenses; nothing in these Terms overrides those underlying licenses.

4. Your data and your server

Rootwise sets up and hosts the ERPNext server that meerkatPOS connects to for your business. We're responsible for keeping that underlying infrastructure secure, available, and backed up. The sales, inventory, customer, and accounting data you enter into it belongs to you, not to us, and you're responsible for the accuracy of that data and for controlling who at your business has access to it. 5. Acceptable use

You agree not to use meerkatPOS or this website to: violate applicable law; attempt to gain unauthorized access to systems or data that aren't yours; interfere with the operation of the software or website; or misrepresent your affiliation with Rootwise Inc.

6. Fees

meerkatPOS is currently free to download and install, and Rootwise currently sets up and hosts your ERPNext server as part of getting you started at no separate charge, as described on this website. Rootwise may introduce paid plans or additional paid services in the future; any such change would be governed by additional terms presented to you at the time.

7. Intellectual property

The meerkatPOS name, logo, and Rootwise's own code and content on this website are the property of Rootwise Inc. Frappe Framework and ERPNext are separate open-source projects and remain the property of their respective contributors under their own licenses.

8. Disclaimer of warranties

meerkatPOS and this website are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the software will be uninterrupted, error-free, or suitable for every business's specific needs.

9. Limitation of liability

To the maximum extent permitted by law, Rootwise Inc. will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, revenue, or profits, arising from your use of meerkatPOS or this website, even if advised of the possibility of such damages.

10. Governing law

These Terms are governed by the laws of Zimbabwe, without regard to conflict-of-law principles. Any dispute arising from these Terms will be subject to the jurisdiction of the courts of Zimbabwe.

11. Changes to these terms

We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent revision. Continuing to use meerkatPOS or this website after a change takes effect means you accept the updated Terms.
